Arsenal, Tottenham, Liverpool and 17 other top clubs hire the City firm to cover mega football claims against Britain’s biggest insurer

Dozens of stadiums have been closed during multiple lockdowns

Some of England’s biggest football clubs – including Arsenal FC, Aston Villa FC, Tottenham Hotspur FC and West Ham FC – have hired City-based law firm Clifford Chance to launch a multi-party lawsuit against some of London’s biggest insurance companies.

The group of 20 plaintiffs, which also includes Liverpool FC and Leicester City FC, are pursuing a lawsuit against Allianz, MSAmlin, Aviva Insurance, CNA Insurance, Zurich Insurance and Liberty, according to public court documents.

The insurance claim is reportedly linked to a business disruption caused by Covid. Filed with commercial court, clubs are seeking damages as a result of the pandemic, The Lawyer reported.

The legal basis for their lawsuit is a test case in the Supreme Court earlier last year over Covid-related business losses. The ruling meant companies can make claims against insurance providers for losses that are a direct result of the pandemic and any lockdown restrictions.

Discuss the case with me this morning City AMSamantha Holland, head of insurance at law firm Gowling WLG, said: “While details of the claims made by football clubs are yet to be released, this appears to be the latest in a series of claims against insurers seeking policyholders to recover Covid-related losses , which have arisen as a result of the lockdown measures put in place during the pandemic.”

Holland explained: “It is clear that the Supreme Court’s decision in last year’s FCA test case was only the beginning, not the end, of the story and there are many other issues including, most recently, the non-denial clauses and causation and damage issues , which have yet to be resolved, which should result in more claims coming to court.”

She added that “many other policyholders will be waiting behind the scenes to see these claims resolved, and insurers may find that new life is being breathed into claims they thought were settled.”

Slaughter and May will work for Aviva Insurance, while DAC represents Beachcroft for Allianz, MSAmlin and Liberty. RPC is hired by CNA Insurance and Zurich Insurance has approached Clyde & Co.
